RELATING TO COURTS AND CIVIL PROCEDURE -- CHILD SAFETY | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 15-5 of the General Laws entitled "Divorce and Separation" is |
2 | hereby amended by adding thereto the following section: |
3 | 15-5-16.8. Child support calculation enforcement. -- (a) Any person that provides |
4 | parental income information to the family court to be used for the calculation of child support |
5 | must do so accurately and under oath. |
6 | (b) If a family court judge finds that untruthful or inaccurate income information has been |
7 | intentionally provided to the court, then he or she shall refer the provider to the state police for |
8 | investigation and possible prosecution. |
9 | (c) Any party or witness who commits a "fraudulent act" during a family court |
10 | proceeding addressing the issue of child support shall be guilty of a felony and upon conviction |
11 | shall be punished by imprisonment of not more than one year or fined one thousand dollars |
12 | ($1,000) or both. "Fraudulent act" means that a party and/or witness made a false representation |
13 | of a material fact or concealed a material fact with the intent to deceive and that the party and/or |
14 | witness intended that the family court rely on their material misrepresentation or misinformation. |
15 | SECTION 2. This act shall take effect upon passage. |
