RELATING TO BUSINESSES AND PROFESSIONS -- AUCTIONEERS

     Introduced By: Representatives Costantino, Marshall, Lima, Winfield, and Trillo

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 5-58 of the General Laws entitled "Auctioneers" is hereby amended

by adding thereto the following section:

     5-58-12. Auctioneer license required to conduct an estate sale. -- No person shall

conduct the sale of the property of a decedent's estate wherein such person is to receive

compensation for his or her services in conducting the sale, unless said person is an auctioneer or

apprentice auctioneer licensed pursuant to the provisions of this chapter. This license requirement

shall not apply to heirs, legatees, devisees, and heirs-at-law of the decedent when such persons

are directly conducting such sale without employing the services of a professional to operate such

sale. Provided further, that heirs, legatees, devisees, and heirs-at-law of the decedent who obtain

an appraisal from a professional appraiser may directly conduct such a sale without the use of a

licensed auctioneer or apprentice auctioneer.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that no person would conduct the sale of the property of a

decedent's estate wherein such person would receive compensation for his or her services in

conducting the sale, unless said person was a licensed auctioneer. This requirement would not

apply to heirs of the decedent directly conducting such sales.

     This act would take effect upon passage.
