RELATING TO STATE AFFAIRS AND GOVERNMENT - DEPARTMENT OF

TRANSPORTATION

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-13 of the General Laws entitled "Department of Transportation"

is hereby amended by adding thereto the following section:

     42-13-8. Road construction business economic hardship relief fund. -- (a) There is

4

hereby created a "road construction business economic hardship relief fund," to be administered

5

and managed by the commerce corporation. The state department of transportation shall set aside

6

ten percent (10%) of each public works road construction project contract and deposit these funds

7

in the relief fund. The fund shall compensate business owners who have motor vehicle access to

8

their businesses denied during and as a result of, road construction and shall be payable to them if

9

their business losses are solely attributable to the denial of access and have been substantiated by

10

a certified public accountant.

     (b) The commerce corporation shall promulgate rules necessary to aid economically

12

disadvantaged businesses in the disbursement of the fund concerning eligibility requirements and

13

the amount of available funds.

     SECTION 2. This act shall take effect upon passage.

     This act would create a road construction business economic hardship relief fund, funded

by ten percent (10%) of all state awarded road construction contracts, to be disbursed to

3

businesses that have suffered economic harm as a result of the road construction denial of vehicle

4

access to them.

5

     This act would take effect upon passage.
