RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     It is enacted by the General Assembly as follows:

     SECTION 1. Sections 23-27.3-118.0, 23-27.3-118.1 and 23-27.3-119.0 of the General

Laws in Chapter 23-27.3 entitled "State Building Code" are hereby amended to read as follows:

     23-27.3-118.0. Fees. -- No permit shall be issued for new construction, alteration,

4

removal, demolition, or other building operation until the fees prescribed by municipal ordinance

5

in accordance with § 23-27.3-119.0 shall have been paid to the city or town collector or other

6

municipal agency authorized to collect the fees.

     23-27.3-118.1. Special fees. -- The payment of the fee for construction, alteration,

8

removal, or demolition and for all work done in connection with or concurrently with the work

9

contemplated by a building permit shall not relieve the applicant or holder of the permit from the

10

payment of other fees that may be prescribed by law or ordinance in accordance with § 23-27.3-

11

119.0 for water taps, sewer connections, electrical, and plumbing permits, erection of signs and

12

display structures, marquees, or other appurtenant structures, or fees for inspections, certificates

13

of use and occupancy for other privileges or requirements, both within and without the

14

jurisdiction of the building department.

     23-27.3-119.0. Fee computation. -- The permit fees assessed by all municipalities shall

16

be computed according to the fee schedule and procedures adopted in each municipality the

17

process and formula either established by, or approved by, the state of Rhode Island building

18

code commission, provided that all fees shall have multipliers that go down as the cost of

19

construction increases in value. No fee shall be assessed for the first reinspection of work that has

failed the initial inspection; provided, a fee shall be allowed for all necessary subsequent

2

reinspections of the same work.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     This act would provide that fees paid for construction permits shall be assessed by all

2

municipalities using a formula established and/or approved by the Rhode Island building code

3

commission which has multipliers that decrease as construction costs increase in value.

4

     This act would take effect upon passage.
