A N   A C T

RELATING TO MILITARY AFFAIRS AND DEFENSE

It is enacted by the General Assembly as follows:

     SECTION 1. Section 30-2-6 of the General Laws in Chapter 30-2 entitled "Organization

and Command of Military and Naval Forces" is hereby amended to read as follows:

     30-2-6. Order of militia into service. -- (a) In case of martial law, war, invasion,

4

rebellion, insurrection, riot, tumult, public calamity requirement for public safety reinforcement

5

or catastrophe, or other emergency, or imminent danger thereof, or resistance to the laws of this

6

state or the United States, the governor shall order into service, all or any part of the militia that

7

he or she may deem necessary, to serve until the exigencies shall have passed. If the occasion be

8

so sudden that the governor cannot be informed and his or her orders received and executed, the

9

adjutant general may order into service all or any part of the militia, with like powers and

10

authority as are herein conferred on the governor.

      (b) In the event of a request for assistance from the state of Rhode Island or an agency

12

thereof, the governor may order into service all or part of the militia that he or she may deem

13

necessary, to serve for the purposes of providing assistance and support for official state

14

functions, military funerals, memorials, commemoratory services or parades in or out of state or

15

other state activities for training.

     SECTION 2. This act shall take effect upon passage.

     This act would authorize the governor to call the National Guard into service for public

safety or memorial service purposes.

     This act would take effect upon passage.
