RELATING TO DOMESTIC RELATIONS - UNIFORM CHILD CUSTODY JURISDICTION

AND ENFORCEMENT ACT

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 15-14.1 of the General Laws entitled "Uniform Child Custody

Jurisdiction and Enforcement Act" is hereby amended by adding thereto the following section:

     15-14.1-43. At-home school instruction - Notice required. – (a) Any parent having

physical custody of a child pursuant to this title who is seeking approval from a city or town or

regional school committee for a course of at-home school instruction whose attendance is

regulated pursuant to §16-19-1 shall provide the child's non-custodial parent with notice of the

application for at-home school instruction. The notice of application to the non-custodial parent

shall be issued prior to the approval of the at-home school instruction determination by any city

or town school committee.

     (b) A non-custodial parent aggrieved by a decision of a school committee to permit home

schooling of their child may appeal that decision to the family court pursuant to the provisions of

§16-19-8.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

AND ENFORCEMENT ACT

     This act would require that custodial parents give non-custodial parents notice of

intentions to apply for at-home schooling. It would also allow appeals of certain school

committee decisions about home-schooling to the family court.

     This act would take effect upon passage.
