RELATING TO STATE AFFAIRS AND GOVERNMENT - DEPARTMENT OF

TRANSPORTATION

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-13 of the General Laws entitled "Department of Transportation"

is hereby amended by adding thereto the following section:

     42-13-8. Maintenance of drainage systems - Consent decree compliance. – The Rhode

Island department of transportation (RI DOT) shall, on or before December 15 of each year,

provide an annual report to the speaker of the house of representatives and the president of the

senate illustrating its compliance with the consent decree issued by the United States District

Court in the case of United States of America v. Rhode Island Department of Transportation

(Civil Action No. CV-15-433), which requires maintenance of drainage systems in compliance

with all applicable federal, state, and local laws, ordinances or regulations.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO STATE AFFAIRS AND GOVERNMENT - DEPARTMENT OF

TRANSPORTATION

     This act would require the Rhode Island department of transportation to annually report

to the speaker of the house of representatives and the president of the senate their compliance

with the consent decree issued by the United States District Court relative to maintenance of

certain drainage systems.

     This act would take effect upon passage.
