A N   A C T

RELATING TO LABOR AND LABOR RELATIONS -- ARBITRATION -- CONTINUANCE

OF CONTRACTUAL PROVISIONS

     Introduced By: Representatives Carnevale, O'Brien, McKiernan, Almeida, and Lima

     Date Introduced: February 04, 2016

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-9.3 of the General Laws entitled "Certified School Teachers'

Arbitration" is hereby amended by adding thereto the following section:

     28-9.3-17. Continuance of contractual provisions. – All contractual provisions

contained in a teachers' collective bargaining agreement entered into pursuant to the provisions of

this chapter shall continue until such time as a successor agreement has been reached between the

parties.

     SECTION 2. Chapter 28-9.4 of the General Laws entitled "Municipal Employees'

Arbitration" is hereby amended by adding thereto the following section:

     28-9.4-20. Continuance of contractual provisions. -- All contractual provisions

contained in a municipal employees' collective bargaining agreement entered into pursuant to the

provisions of this chapter shall continue until such time as a successor agreement has been

reached between the parties.

     SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO LABOR AND LABOR RELATIONS -- ARBITRATION -- CONTINUANCE

OF CONTRACTUAL PROVISIONS

     This act would require that all contractual provisions contained in an expired collective

bargaining agreement with certified school teachers and municipal employees continue until a

successor agreement has been reached between the parties.

     This act would take effect upon passage.
