A N   A C T

RELATING TO HIGHWAYS - CONSTRUCTION AND MAINTENANCE OF STATE

ROADS

     Introduced By: Representatives Solomon, Coughlin, Casey, and Morin

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 24-8 of the General Laws entitled "Construction and Maintenance

of State Roads" is hereby amended by adding thereto the following section:

     24-8-45. Central registry of contracting opportunities for construction and

maintenance of state roads. -- (a) The director of the department of transportation shall publish

and maintain on the department's website a central registry of all proposals and contracts awarded

pursuant to §§24-8-12 or 24-8-22 when the proposal or contract is estimated to be in excess of

one hundred thousand dollars ($100,000). Notices published in the central registry shall include,

but not be limited to:

     (1) Invitations issued pursuant to the advertisement for bids under §§24-8-12 and 24-8-22

with an estimated contract cost in excess of one hundred thousand dollars ($100,000).

     (2) Contract awards and the identification of the contractor awarded the contract pursuant

to §§24-8-12 and 24-8-22 with an estimated contract cost in excess of one hundred thousand

dollars ($100,000), and any and all subcontractors shall be included in the placement of the

contract award.

     (3) Any and all dates included in the contract as conditions to either start, progress or

complete any project contracted for, and to complete or repair the road construction or

improvement within the specified time.

     (b) Every thirty (30) days after the award of any contract pursuant to §§24-8-12 or 24-8-

22 the director of the department of transportation shall publish on the department's website an

update of any contract awarded which shall include:

     (1) Any delays in the start, progress or completion of any contract award; or

     (2) Any cost overages which are in excess of any award amount.

     (c) The director shall promulgate rules and regulations necessary to implement the

provisions of this section in accordance with the provisions of chapter 35 of title 42 (the

"administrative procedures act").

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

ROADS

     This act would require the department of transportation to publish on its website the

award of contracts and information related thereto for the construction and maintenance of state

roads and bridges where the cost is in excess of $100,000, as well as the estimated total amount of

the contract and any dates relative to starting or completing the project contracted for.

     This act would take effect upon passage.
