RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

It is enacted by the General Assembly as follows:

     SECTION 1. Sections 23-27.3-113.6 and 23-27.3-128.2.1 of the General Laws in Chapter

2

23-27.3 entitled "State Building Code" are hereby amended to read as follows:

     23-27.3-113.6. Plot plan. -- There shall also be filed a plot plan showing to scale the size

4

and location of all the new construction and all existing structures on the site, distances from lot

5

lines, and the established street grades; and the plan shall be drawn in accordance with an

6

accurate boundary line survey, and, when necessary, by a registered land surveyor if required by

7

the building official. If the building and/or zoning official determines that a site plan or plot plan

8

is necessary, it shall be prepared by a registered professional land surveyor as defined in §5-8.1-

9

2(14) and in accordance with rules and regulations as defined in §5-8.1-2(19). If demolition is to

10

be performed, the plot plan shall show all construction to be demolished, and the location and size

11

of all existing buildings and construction that are to remain on the site or plot. The plot plan shall

12

not be changed except as specified in § 23-27.3-115.4.

     23-27.3-128.2.1. Drawings and specifications. -- All drawings, specifications, and

14

computations for new construction, alteration, repair, or expansion work involving the practice of

15

professional engineering, professional land surveying, or architecture as defined by Rhode Island

16

state law, shall be prepared by professional engineers, professional land surveyors, or registered

17

architects as licensed or registered by the state. All the drawings, computations, and specifications

18

required for a building permit application for the work, must be prepared by or under the direct

19

supervision of a professional engineer, professional land surveyor, or registered architect and bear

his or her signature and seal in accordance with the Rhode Island statutes and regulations

2

governing the professional licensing or registration of engineers, land surveyors, or architects,

3

and shall signify to the best of his or her knowledge that the drawings, computations, and

4

specifications shall meet the applicable provisions of this code and acceptable engineering

5

practices and all applicable laws and ordinances.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     This act would require that all plot plans be prepared by professional engineers,

2

professional surveyors or registered architects, and would prohibit anyone acting under the direct

3

supervision of those professionals from preparing such plans, drawings or specifications.

4

     This act would take effect upon passage.
