A N   A C T

     RELATING TO TOWNS AND CITIES - FIREWORKS SALES ORDINANCES

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-28.11-10 of the General Laws in Chapter 23-28.11 entitled

"Fireworks and Pyrotechnics" is hereby amended to read as follows:

     23-28.11-10. Rules and regulations. – (a) The state fire marshal is hereby authorized

and directed to promulgate reasonable rules and regulations governing the possession, sale

wholesale and retail, and use of display fireworks and aerial consumer fireworks and pyrotechnics

in the state.

     (b) All cities and towns in this state are hereby authorized to regulate, by ordinance, the

time, place, and manner of sale of legal fireworks and pyrotechnics within their boundaries, and

to require that a special pyrotechnics sales license be purchased from the city or town at a cost not

to exceed one thousand dollars ($1,000) per license. The provisions of this section shall be in

addition to the provisions of §23-28.11-3(c).

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would authorize cities and towns to regulate by ordinance the sale of

pyrotechnics within their boundaries, and to set a sales license fee of not more than one thousand

dollars ($1,000).

     This act would take effect upon passage.
