RELATING TO HEALTH AND SAFETY - EXPLOSIVES - NOTICE | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-28.28-37 of the General Laws in Chapter 23-28.28 entitled |
2 | "Explosives" is hereby amended to read as follows: |
3 | 23-28.28-37. Notice to adjoining landowners. – (a) Prior to the commencement of |
4 | blasting operations, any person, firm, corporation, or other entity that is regulated pursuant to the |
5 | provisions of this chapter shall notify the owner or owners of record of any improved real |
6 | property within five hundred (500') feet, as measured from the nearest borehole to the closest |
7 | improved real property, of an intended blast or detonation, excluding road, bridge, utility, and |
8 | public works construction, no less than twenty-four (24) hours prior to the blast or detonation. |
9 | (b) Notice shall also be given to any owner or owners of real property on which a |
10 | structure is located, which structure is located within five hundred feet (500') of the property line |
11 | of the property on which the blasting is to take place, and to the city or town council of the |
12 | municipality within which such property is located, no less than fourteen (14) days prior to the |
13 | blast or detonation. Quarries and mines authorized to operate shall be exempt from the |
14 | requirements of this subsection. |
15 | SECTION 2. This act shall take effect upon passage. |
