RELATING TO BUSINESSES AND PROFESSIONS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 31-2 of the General Laws entitled "Division of Motor Vehicles" is |
2 | hereby amended by adding thereto the following sections: |
3 | 31-2-3.1. Division of motor vehicles service member licensure. -- (a) The administrator |
4 | of the division of motor vehicles and each of their examining and licensing boards shall, upon |
5 | presentation of satisfactory evidence by an applicant for certification or licensure, accept |
6 | education, training, or service completed by an individual as a member of the Armed Forces or |
7 | Reserves of the United States, the National Guard of any state, the Military Reserves of any state, |
8 | or the Naval Militia of any state toward the qualifications to receive the license or certification. |
9 | The administrator of the division of motor vehicles and each of their examining and licensing |
10 | boards shall promulgate rules to implement this section. |
11 | (b) The administrator and each of their examining and licensing boards shall establish a |
12 | procedure to expedite the issuance of a license, certification or permit to perform professional |
13 | services regulated by each such board to a person who is certified or licensed in another state to |
14 | perform professional services in a state other than Rhode Island. The procedure shall include: |
15 | (1) Issuing the person a license, certificate or permit, if, in the opinion of the |
16 | administrator or their board members, the requirements for certification or licensure of such other |
17 | state are substantially equivalent to that required in this state; or |
18 | (2) Developing a method to authorize the person to perform professional services |
19 | regulated by the administrator and their board members in this state by issuing the person a |

1 | temporary permit for a limited period of time to allow the person to perform professional services |
2 | while completing any specific requirements that may be required in this state that were not |
3 | required in the state in which the person was licensed or certified. |
4 | 31-2-3.2. Division of motor vehicles military spouse licensure. -- (a) The division of |
5 | motor vehicles shall establish a procedure to expedite the issuance of a license, certification or |
6 | permit to perform professional services regulated by the division to a person: |
7 | (1) Who is certified or licensed in another state to perform professional services in a state |
8 | other than Rhode Island; |
9 | (2) Whose spouse is a member of the armed forces of the United States; |
10 | (3) Whose spouse is the subject of a military transfer to Rhode Island; and |
11 | (4) Who left employment to accompany the person's spouse to Rhode Island. |
12 | (b) The procedure shall include: |
13 | (1) Issuing the person a license, certificate or permit, if, in the opinion of the |
14 | administration, the requirements for certification or licensure of such other state are substantially |
15 | equivalent to that required in this state; or |
16 | (2) Developing a method to authorize the person to perform professional services |
17 | regulated by the division in this state by issuing the person a temporary permit for a limited |
18 | period of time to allow the person to perform professional services while completing any specific |
19 | requirements that may be required in this state that were not required in the state in which the |
20 | person was licensed or certified. |
21 | SECTION 2. Chapter 42-11 of the General Laws entitled "Department of |
22 | Administration" is hereby amended by adding thereto the following sections: |
23 | 42-11-2.7. Department of administration service member licensure. -- (a) The |
24 | director of the department of administration and each of their examining and licensing boards |
25 | shall, upon presentation of satisfactory evidence by an applicant for certification or licensure, |
26 | accept education, training, or service completed by an individual as a member of the Armed |
27 | Forces or Reserves of the United States, the National Guard of any state, the Military Reserves of |
28 | any state, or the Naval Militia of any state toward the qualifications to receive the license or |
29 | certification. The director of the department of administration and each of their examining and |
30 | licensing boards shall promulgate rules to implement this section. |
31 | (b) The director and each of their examining and licensing boards shall establish a |
32 | procedure to expedite the issuance of a license, certification or permit to perform professional |

14 | (2) Whose spouse is a member of the armed forces of the United States; |
15 | (3) Whose spouse is the subject of a military transfer to Rhode Island; and |
16 | (4) Who left employment to accompany the person's spouse to Rhode Island. |
