It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 31-26 of the General Laws entitled "Accidents and Accident |
2 | Reports" is hereby amended by adding thereto the following section: |
3 | 31-26-1.1. Motor vehicle accidents-Death resulting-Blood testing. -- When the death |
4 | of any person or persons ensues as a proximate result of an injury received by the operation of |
5 | any motor vehicle, the operator of the motor vehicle or operators if more than one vehicle is |
6 | involved, shall submit to a chemical analysis of their blood. In such event, no search warrant shall |
7 | be required for such testing. |
8 | SECTION 2. This act shall take effect upon passage. |
