A N   A C T

RELATING TO DOMESTIC RELATIONS -- INTERSTATE COMPACT ON ADOPTION

MEDICAL ASSISTANCE ACT--DEPARTMENT OF CHILDREN, YOUTH AND FAMILIES

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 15-7.1 of the General Laws entitled "Interstate Compact on

Adoption and Medical Assistance" is hereby amended by adding thereto the following section:

     15-7.1-5. Continued payments. – (a) Notwithstanding any regulations to the contrary,

including, but not limited to, the department of children, youth and families ("DCYF") adoption

subsidy regulations, the DCYF shall promulgate rules, regulations and plans for an eligible

subsequent foster parent/adoptive parent to continue to receive the adoption subsidy and medical

assistance for a special needs child after the death of both adoptive parents or a single adoptive

parent of a special needs child receiving an adoption subsidy/adopted assistance, pursuant to §15-

7.1-1.

     (b) For the purpose of this section:

     (1) "Parent(s)" means one or two (2) persons who are married or who live together

including individuals of the same sex.

     (2) "Adoption" means the creation of a parent-child relationship by judicial order

between one party and/or two (2) parties and a child or children.

     (3) "Foster parent(s)" means a party or parties who have a child/children placed in their

home with a person or persons who provide parental care.

     (4) "Special needs child" means a child/children with medical problems or with a

physical or emotional handicap.

     SECTION 2. This act shall take effect upon passage.

MEDICAL ASSISTANCE ACT--DEPARTMENT OF CHILDREN, YOUTH AND FAMILIES

     This act would require the DCYF to promulgate rules and a plan to continue the adoption

subsidy/adoption assistance for a special needs child upon the death of both adoptive parents or of

a single parent of a special needs child(ren) for subsequent eligible foster parent(s) or adoptive

parent(s).

     This act would take effect upon passage.
