A N   A C T

IN AMENDMENT OF CHAPTER 974 OF THE PUBLIC LAWS, 1940, ENTITLED "AN ACT

TO INCORPORATE THE STONE BRIDGE FIRE DISTRICT AND TO FURNISH A SUPPLY

OF WATER FOR THE TOWN OF TIVERTON," AS AMENDED

     It is enacted by the General Assembly as follows:

     SECTION 1. Sections 3 and 4 of chapter 974 of the public laws, 1940, entitled "An Act

to incorporate the Stone Bridge fire district and to furnish a supply of water for the town of

3

Tiverton" as amended, and hereby further amended to read as follows:

     Section 3. A special meeting of said district shall be held on the first Tuesday in June in

5

the year 1940, the polls to be open for the election of the several officers named in section 4

6

hereof, from six o'clock in the afternoon until eight o'clock in the evening. Thereafter there shall

7

be an annual meeting on the second Tuesday in June July in every year. Special meetings of said

8

district shall be called by the clerk upon order of the administrative board or upon written

9

application of at least twenty-five (25) electors. It shall be the duty of the clerk to fix a suitable

10

place for the holding of all meetings and to give notice of each meeting, both annual and special,

11

by posting such notice at the principal office of the district and in at least one other prominent

12

place within the district boundaries, not less than seven (7) days before the meeting, and by

13

publishing a copy of said public notice, at least once, in a newspaper of general circulation in the

14

district, said newspaper publication to occur at least forty-eight (48) hours before the meeting

15

commences, and such notice shall contain a statement of the time and place when and where a

16

meeting will be held for the purpose of correcting and canvassing the voting list to be used at any

17

such annual or special meeting. as follows:

     In January of each year, a listing of the dates of all regular meetings and the annual

meeting for the calendar year shall be posted electronically with the Rhode Island secretary of

2

state. A supplemental notice, with agenda, of each regular meeting and the annual meeting shall

3

be posted electronically with the secretary of state a minimum of forty-eight (48) hours before the

4

meeting. Said notices shall be posted in the district office and in one other prominent location

5

within the district at least forty-eight (48) hours before the meeting. If a special meeting is called,

6

a meeting notice and agenda shall be posted in the district and filed with the secretary of state as

7

soon as practicable. Supplemental notices of regular and annual meetings and special meetings

8

will also include the date the notice was posted and the date(s), time(s), and location(s) of the

9

meetings.

     and it It shall be the duty of the assessors of taxes of said district, to canvass and correct

11

said voting list in the same manner, as near as may be, as is provided by law for boards of

12

canvassers; provided, however, that it shall be the duty of the town council of the town of

13

Tiverton to fix a suitable place within the district for the holding of the first annual meeting, to

14

choose a moderator and clerk therefor, and to canvass and correct the voting list to be used

15

thereat, and it shall be the duty of the town council of the town of Tiverton to fix a suitable place

16

within the district for the holding of the first annual meeting, to choose a moderator and clerk

17

therefor, and to canvass and correct the voting list to be used thereat, and it shall be the duty of

18

the town clerk of Tiverton to give notice of such annual meeting in the same manner as is

19

provided in this section for notice by the clerk of said district and said town clerk shall also

20

provide for use at such annual meeting a ballot box, and certified copies of the voting list to be

21

used thereat. No vote, except upon an adjournment or in the annual election of officers, shall be

22

taken at any the annual meeting of the district unless at least twelve (12) electors are present at

23

such meeting.

     Section 4. The electors of said district shall, at the annual meeting held the second

25

Tuesday in June, 1950, elect a moderator to serve for one year, a district clerk to serve for two (2)

26

years, a tax collector to serve for two (2) years, a treasurer to serve for one year, one tax assessor

27

to serve for two (2) years, and two tax assessors to serve each for one year, and until their

28

successors are elected and qualified, whose duties and powers shall be within said district, such as

29

like officers of towns in this state have in their respective towns, proper for such district.

Thereafter in sequence at the annual elections held the second Tuesday in June July, with the

31

exception of one tax assessor who shall hold office for one year, the respective successors of each

32

of said officers shall be chosen for terms of two (2) years and shall hold office until their

33

successors are elected and qualified. Such officers shall constitute the administrative board, and

34

the duties of such board shall be such as are prescribed in this act, and are defined by the by-laws

of said district. Any vacancy that may occur in any of the aforenamed offices between annual

2

meetings shall be filled by some person to be chosen by the other members of the administrative

3

board to hold such office until the next annual meeting. The electors of said district may at any

4

meeting adopt and ordain such by-laws and from time to time rescind or amend the same, as they

5

shall deem necessary and proper for the purposes of this act and not repugnant thereto and not

6

inconsistent with any other law; provided, that no greater penalty shall be inflicted thereby than is

7

prescribed in section 9 hereof, and said electors may appoint such committees as they may deem

8

necessary, and may fix the compensation of all officers, agents, employees, and committees of the

9

district.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

     This act would move the annual meeting of the district from June to July, and conform

2

the notice requirements to those prescribed by statute, requiring posting on the secretary of state's

3

website.

     This act would take effect upon passage.
