RELATING TO CRIMINAL PROCEDURE -- SEARCH WARRANTS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 12-5 of the General Laws entitled "Search Warrants" is hereby |
2 | amended by adding thereto the following section: |
3 | 12-5-11. Sealing of search warrant. -- The clerk of any court receiving an application |
4 | for the issuance of a search warrant shall seal the application and all related records and orders |
5 | until such time as charges are brought against any individual or entity pursuant to or with respect |
6 | to such warrant, unless the court issuing the warrant issues an order granting an individual or |
7 | entity relief from the seal upon good cause shown, including an assertion that the record is |
8 | necessary for the preparation of a defense by the person or entity charged. |
9 | SECTION 2. This act shall take effect upon passage. |
