RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 12-28 of the General Laws entitled "Victim's Rights" is hereby

amended by adding thereto the following section:

     12-28-3.1. Right of victim's representatives to consult with the department of the

attorney general in motor vehicle matters resulting in death. -- In any case wherein a person

is a suspect in a crime involving a motor vehicle offense under title 31, death resulting, and a

decision has been made not to prosecute the operator of a motor vehicle involved, the attorney

general shall provide written notice to the victim's representatives advising them of their right to

meet with the attorney general or designee to discuss the reason or reasons for the decision not to

prosecute.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS

     This act would provide that in cases where there is a motor vehicle accident with death

resulting, if the attorney general decides not to prosecute a criminal case, that the attorney general

shall give the decedent's representatives an opportunity to discuss why the matter is not being

prosecuted.

     This act would take effect upon passage.
