RELATING TO COURTS AND CIVIL PROCEDURE - COURTS - JUDICIAL

ADMINISTRATION

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 8-15 of the General Laws entitled "Court Administration" is hereby

amended by adding thereto the following section:

     8-15-9.4. Procedure for civil payment reviews. – (a) In all civil cases in any court in

4

which an order is issued for the payment of court-related fines, costs, or fees, and these fines,

5

costs or fees remain unpaid, the court shall schedule a payment review hearing. This review

6

hearing shall be scheduled to occur no later than two (2) years after the last prior court date or last

7

prior payment review hearing date, whichever is later.

     (b) At the payment review hearing required by this subsection, any person who claims

9

that payment has been made or that the person is unable to pay these moneys shall be afforded an

10

opportunity to be heard.

     (1) Payment review hearings shall continue every two (2) years until the court-related

12

fines, costs, or fees are paid, or are otherwise resolved or discharged.

13

     (2) In the event a period greater than two (2) years has elapsed since the last payment

14

review hearing, the court shall be deemed to have waived and discharged the balance of any

15

court-related fines, costs, or fees due.

     SECTION 2. This act shall take effect upon passage.

     This act would provide that in all civil cases where an order is issued for the payment of

court-related fines, costs, or fees, and these fines, costs or fees remain unpaid, the court would

3

schedule a payment review hearing within two (2) years after the last court date or last payment

4

review hearing date. If more than two (2) years have elapsed from the last court hearing or

5

payment review hearing, any balance owed would be deemed waived and to be discharged.

6

     This act would take effect upon passage.
