A N   A C T

RELATING TO FOOD AND DRUGS -- MEDICAL MARIJUANA ACT

     Introduced By: Representatives Lima, DeSimone, Carnevale, Lombardi, and Almeida

     Date Introduced: April 14, 2016

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 21-28.6 of the General Laws entitled "The Edward O. Hawkins and

Thomas C. Slater Medical Marijuana Act" is hereby amended by adding thereto the following

section:

     21-28.6-7.1. Licensing of private and business establishments -- Consumption of

marijuana. – (a) The state retains the exclusive power and authority to issue any and all licenses

required to operate a private or business establishment which permits the use of marijuana on its

premises pursuant to the provisions of this chapter.

     (b) The department of business regulation shall issue any and all licenses required under

subsection (a) of this section and shall promulgate any and all rules and regulations governing

their issuance upon written applications to be developed and provided by the department.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would make the department of business regulation the exclusive government

authority regarding the issuance of licenses to private and business establishments which permit

the use of marijuana on their premises.

     This act would take effect upon passage.
