A N   A C T

RELATING TO ANIMALS AND ANIMAL HUSBANDRY

     

     Introduced By: Representatives Trillo, Costa, and Lima

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 4-19 of the General Laws entitled "Animal Care" is hereby

amended by adding thereto the following section:

     4-19-5.1. Animal confinement in pet store sales display window prohibited. – No pet

4

shop owner shall confine any animal in a sales display window in a manner that places the animal

5

in direct sunlight without providing some form of cover or shade for the animal such as an

6

awning. A violation of this section shall be considered a mistreatment of an animal and be subject

7

to the penalties set forth in §4-19-11.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

A N   A C T

RELATING TO ANIMALS AND ANIMAL HUSBANDRY

     This act would prohibit any pet shop owner from confining any animal in a sales display

2

window in a manner that places the animal in direct sunlight, without providing some form of

3

cover or shade. Engaging in such an act would be a mistreatment of an animal and be subject to

4

the penalties provided for in §4-19-11, the text of which is set forth below:

5

     "Failure of any person licensed or registered to adequately house, feed and water animals

6

in his or her possession or custody shall constitute a misdemeanor, and upon conviction the

7

person shall be subject to a fine of not more than one hundred dollars ($100) per animal. Those

8

animals shall be subject to seizure and impoundment and upon conviction of the person may be

9

sold or euthanized at the discretion of the director and that failure shall also constitute grounds for

10

revocation of license or registration after a public hearing."

     This act would take effect upon passage.
