RELATING TO MOTOR AND OTHER VEHICLES - PEDESTRIANS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-18-8 of the General Laws in Chapter 31-18 entitled

"Pedestrians" is hereby amended to read as follows:

     31-18-8. Due care by drivers. -- Notwithstanding other provisions of this chapter or the

4

provisions of any local ordinance, every driver of a vehicle shall exercise due care to avoid

5

colliding with any pedestrian, jogger, runner or any person propelling a human-powered vehicle

6

upon any roadway, shall give an audible signal when necessary, and shall exercise proper

7

precaution upon observing any child or any obviously confused, intoxicated, or incapacitated

8

person. For the purpose of this section, "due care" shall require the driver to leave at least three

9

feet (3') between the driver's vehicle and what the driver could reasonably anticipate the

10

pedestrian's position to be. Violations of this section are subject to fines enumerated in ยง 31-41.1-

11

4.

     SECTION 2. This act shall take effect upon passage.

     This act would require drivers of motor vehicles to stay at least three feet (3') away from

pedestrians.

     This act would take effect upon passage.
