A N   A C T

RELATING TO PUBLIC UTILITIES AND CARRIERS - PUBLIC MOTOR VEHICLE

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 39-14.1-3 of the General Laws in Chapter 39-14.1 entitled "Public

Motor Vehicles" is hereby amended to read as follows:

     39-14.1-3. Certificate required for public motor vehicle operation. -- (a) Application

4

and fee. - No person shall operate a public motor vehicle in any city or town in the state until the

5

person shall have obtained a certificate from the division certifying that the applicant is fit,

6

willing, and able to provide the services as a public motor vehicle in the transportation of

7

passengers. The certificate shall be issued only after written application for it, accompanied by a

8

fee of two hundred fifty dollars ($250) and after a public hearing has been conducted on it. All

9

revenues under this section shall be deposited as general revenues. Certificates issued under this

10

chapter shall be renewed before the close of business on December 31, of each calendar year. The

11

renewal fee shall be one hundred dollars ($100) and shall be submitted with the renewal form. All

12

revenues received under this section shall be deposited as general revenues.

     (b) The division shall immediately impose a moratorium on the issuance of all new

14

certificates authorizing the operation of public motor vehicles, which shall expire on June 30,

15

2017.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require the division of public utilities and carriers to impose a moratorium

2

on the issuance of all new certificates authorizing the operation of public motor vehicles until

3

June 30, 2017.

     This act would take effect upon passage.
