RELATING TO PUBLIC UTILITIES AND CARRIERS -- REGULATORY POWERS OF

ADMINISTRATION

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 39-3-2 of the General Laws in Chapter 39-3 entitled "Regulatory

Powers of Administration" is hereby amended to read as follows:

     39-3-2. Persons and companies eligible for certificates. -- (a) No certificate shall be

4

issued to any person who is not a citizen resident within this state, or to any association, unless all

5

members of the association are citizens of this state, or to any corporation unless the corporation

6

has been created by special act of the general assembly upon petition for the same. Notice of the

7

pendency of the petition shall be given in such manner as the general assembly may by general

8

law or special act prescribe; provided, however, that the prohibition contained in this section shall

9

not apply to any corporation lawfully doing business in this state as a public utility prior to March

10

1, 1926.

     (b) No certificate shall be issued to any person, association, corporation or entity and/or

12

its shareholders, members or affiliates, by the division or administrator, if said applicant has had a

13

prior certificate of authority revoked by the division or administrator for disciplinary reasons or

14

for failure to comply with an existing order of the division or administrator.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

RELATING TO PUBLIC UTILITIES AND CARRIERS -- REGULATORY POWERS OF

ADMINISTRATION

     This act would bar any person, association, corporation or other entity or its shareholders,

2

members or affiliates from being issued a certificate of necessity for selling electricity or gas by

3

the PUC if a prior certificate has been revoked for disciplinary reasons or failure to comply with

4

prior existing order(s) of the PUC.

5

     This act would take effect upon passage.
