RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 12-28 of the General Laws entitled "Victim's Rights" is hereby |
2 | amended by adding thereto the following section: |
3 | 12-28-3.1. Right of victim's representatives to consult with the department of the |
4 | attorney general in motor vehicle matters resulting in death. |
5 | In any case wherein a person is a suspect in a crime involving a motor vehicle offense |
6 | under title 31, death resulting, and a decision has been made not to prosecute the operator of a |
7 | motor vehicle involved, the attorney general shall provide written notice to the victim's |
8 | representatives advising them of their right to meet with the attorney general or designee to |
9 | discuss the reason or reasons for the decision not to prosecute. |
10 | SECTION 2. This act shall take effect upon passage. |

1 | This act would provide that in cases where there is a motor vehicle accident with death |
2 | resulting, if the attorney general decides not to prosecute a criminal case, that the attorney general |
3 | shall give the decedent's representatives an opportunity to discuss why the matter is not being |
4 | prosecuted. |
5 | This act would take effect upon passage. |
