A N   A C T

RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 12-28 of the General Laws entitled "Victim's Rights" is hereby

amended by adding thereto the following section:

     12-28-3.1. Right of victim's representatives to consult with the department of the

4

attorney general in motor vehicle matters resulting in death.

5

     In any case wherein a person is a suspect in a crime involving a motor vehicle offense

6

under title 31, death resulting, and a decision has been made not to prosecute the operator of a

7

motor vehicle involved, the attorney general shall provide written notice to the victim's

8

representatives advising them of their right to meet with the attorney general or designee to

9

discuss the reason or reasons for the decision not to prosecute.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS

     This act would provide that in cases where there is a motor vehicle accident with death

2

resulting, if the attorney general decides not to prosecute a criminal case, that the attorney general

3

shall give the decedent's representatives an opportunity to discuss why the matter is not being

4

prosecuted.

5

     This act would take effect upon passage.
