RELATING TO MOTOR AND OTHER VEHICLES -- OPERATORS' AND CHAUFFEURS'

LICENSES

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-10-33 of the General Laws in Chapter 31-10 entitled "Operators'

and Chauffeurs' Licenses" is hereby amended to read as follows:

     31-10-33. Records to be kept by the division of motor vehicles.

     (a) The division of motor vehicles shall file every application for a license received by it

and shall maintain suitable indexes containing, in alphabetical order:

      (1) All applications denied and on each application shall note the reasons for the denial;

      (2) All applications granted; and

      (3) The name of every licensee whose license has been suspended or revoked and after

each name shall note the reasons for the action.

      (b) The division of motor vehicles shall also file all accident reports and abstracts of

court records of convictions received by it under the laws of this state. The division shall maintain

convenient records or make suitable notations in order that an individual record of each licensee

showing the convictions of that licensee and the traffic accidents in which the licensee has been

involved shall be readily ascertainable and available for the consideration of the division of motor

vehicles upon any application for a renewal of license and at other suitable times.

     (c) The division of motor vehicles shall not, absent a court authorized search warrant,

provide, share, or give any photograph or digital image of any applicant for an operator's license

or chauffeur's license or of any person who possesses an operator's license or chauffeur's license

to the Federal Bureau of Investigation or any other federal law enforcement agency or division

thereof.

     SECTION 2. This act shall take effect upon passage.

     This act would prevent the division of motor of vehicles from giving any photograph or

digital image of an applicant or holder of an operator's or chauffeur's license to the Federal

Bureau of Investigation or any other federal law enforcement agency absent a court authorized

search warrant.

     This act would take effect upon passage.
