RELATING TO HEALTH AND SAFETY - SEXUALLY TRANSMITTED DISEASES

It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-11-9 of the General Laws in Chapter 23-11 entitled "Sexually

Transmitted Diseases" is hereby repealed.

     23-11-9. Information confidential -- Penalty for disclosure.

     All information and reports in connection with persons suffering from or suspected to be

5

suffering from the diseases mentioned in this chapter shall be regarded as absolutely confidential

6

by any and every person, body, or committee whose duty it is or may be to obtain, make,

7

transmit, and receive that information and reports. Any person who knowingly, outside of the

8

requirements of this chapter, divulges the name of or gives any information relating to any person

9

suffering or suspected to be suffering from sexually transmitted diseases shall be imprisoned not

10

more than six (6) months or fined not more than two hundred fifty dollars ($250).

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO HEALTH AND SAFETY - SEXUALLY TRANSMITTED DISEASES

     This act would repeal the law which provides enhanced penalties of a fine of not more

2

than $250 and imprisonment for not more than six months for disclosure of health care

3

information with respect to an individual diagnosis and treatment of a sexually transmitted

4

disease. The confidentiality of the records are protected in ยง5-37.3 which is the confidentiality of

5

health care communications and information act.

6

     This act would take effect upon passage.
