RELATING TO MOTOR AND OTHER VEHICLES -- ROAD TEST

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-10-22 of the General Laws in Chapter 31-10 entitled "Operators'

2

and Chauffeurs' Licenses" is hereby amended to read as follows:

     SECTION 1. Section 31-10-22 of the General Laws in Chapter 31-10 entitled "Operators'

4

and Chauffeurs' Licenses" is hereby amended to read as follows:

     31-10-22. Road test.

6

     (a) All applicants for a motor vehicle license shall pass a motor vehicle road test as

7

prescribed by the administrator of the division of motor vehicles in a motor vehicle supplied by

8

the applicant or in a dual controlled motor vehicle supplied by the state. In the case of the

9

examination for a chauffeur to operate a truck, tractor, trailer, tractor semi-trailer, bus, or other

10

vehicle for hire or a person who will operate only a vehicle equipped with automatic shift or a

11

person who is disabled and requires the use of a specially equipped motor vehicle, those persons

12

shall be examined in vehicles furnished by them. At the option of any person who is disabled, the

13

road test shall be administered by the local office of the division of motor vehicles nearest that

14

person's home. A fee of twenty-five dollars ($25) shall be charged for all road tests, including

15

repeat road tests, following failure of a road test.

     (b) Any applicant for a motor vehicle license, with limited English proficiency (LEP)

17

may during the road test, be accompanied by an interpreter, at their own expense and choosing,

18

who may translate the road test examiner's directions to the applicant. The interpreter shall be

19

eighteen (18) years of age or older. The applicant shall be responsible for and assume all liability

for the presence of the interpreter in the motor vehicle. The division of motor vehicles is

2

authorized and directed to promulgate rules and regulations necessary to carry out the provisions

3

of this subsection.

     SECTION 2. This act shall take effect on January 1, 2018.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

A N   A C T

RELATING TO MOTOR AND OTHER VEHICLES -- ROAD TEST

     This act would, at no cost to the state, allow a person who is bilingual or not proficient in

2

the English language, to be assisted in their road test by a translator of their native language who

3

is at least eighteen (18) years of age.

4

     This act would take effect on January 1, 2018.
