RELATING TO CRIMINAL OFFENSES -- SEXUAL ASSAULT | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 11-37-6 of the General Laws in Chapter 11-37 entitled "Sexual |
2 | Assault" is hereby amended to read as follows: |
3 | 11-37-6. Third degree sexual assault. |
4 | A person is guilty of third degree sexual assault if he or she is over the age of eighteen |
5 | (18) years and engaged in sexual penetration with another person over the age of fourteen (14) |
6 | years and under the age of consent, sixteen (16) eighteen (18) years of age; provided, however, |
7 | that it shall not be a violation if the parties engaging in sexual penetration are doing so |
8 | consensually, are between the ages of sixteen (16) and twenty (20) years of age and that they are |
9 | no more than thirty (30) months apart in age. |
10 | SECTION 2. This act shall take effect upon passage. |

1 | This act would raise the age of consent for sexual intercourse to age eighteen (18); |
2 | provided however that consensual penetration between two individuals between the ages of |
3 | sixteen (16) and twenty (20) if they are no more than thirty (30) months apart in age, would not |
4 | be a violation of this statute. |
5 | This act would take effect upon passage. |
