A N   A C T

RELATING TO HIGHWAYS -- ROADS AND BRIDGES FUNDING

     Introduced By: Representatives Morgan, Mendonca, Quattrocchi, Giarrusso, and Lancia

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 24-8 of the General Laws entitled "Construction and Maintenance

of State Roads" is hereby amended by adding thereto the following section:

     24-8-1.8. Funding of state roads' and bridges' maintenance and construction.

     (a) There is hereby created a state road and bridge maintenance and construction trust

fund to be administered by the state department of transportation.

     (b) This trust fund shall be supported by the following sources:

     (1) All of the toll revenue generated pursuant to chapter 13.1 of title 42.

     (2) All revenues derived from the fees and taxes levied on fuels used for the operation of

motor vehicles collected pursuant to chapter 36 of title 31.

     (3) All of the fees and other funds relating to the registration, operation and use of

vehicles on public highways, collected by the division of motor vehicles within the department of

revenue, pursuant to title 31.

     (c) All the funds generated pursuant to subsection (b) of this section shall be used

exclusively for payment of debts and liabilities incurred in construction and reconstruction of

highways and bridges, the cost of construction, reconstruction, maintenance and repair of public

highways and bridges under the direction and supervision of a state department of transportation

jurisdiction over such highways and bridges.

     (d) The identification and scheduling of the projects to be undertaken shall be set by the

state department of transportation.

     (e) The trust funds shall not be diverted for any other purpose.

     SECTION 2. This act shall take effect on July 1, 2017.

BY THE LEGISLATIVE COUNCIL

RELATING TO HIGHWAYS -- ROADS AND BRIDGES FUNDING

     This act would create a trust fund, funded by road and bridge tolls, the gasoline tax and

fees generated by the division of motor vehicles to pay for the maintenance and construction of

state roads and bridges.

     This act would take effect on July 1, 2017.
