It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 6-48 of the General Laws entitled "Consumer Empowerment and |
2 | Identity Theft Prevention Act of 2006" is hereby amended by adding thereto the following |
3 | section: |
4 | 6-48-8.1. Personal information - prohibition. |
5 | No telecommunications or Internet service provider that has entered into a franchise |
6 | agreement, right-of-way agreement, or other contract with the state of Rhode Island or political |
7 | subdivision, instrumentality or quasi-public agency of the same, or that uses facilities that are |
8 | subject to such agreements, even if it is not a party to the agreement, may collect personal |
9 | information from a customer resulting from the customer's use of the telecommunications or |
10 | Internet service provider without express written approval from the customer. No such |
11 | telecommunication or Internet service provider shall refuse to provide its services to a customer |
12 | on the grounds that the customer has not approved collection of the customer's personal |
13 | information. |
14 | SECTION 2. This act shall take effect upon passage. |
