RELATING TO COMMERCIAL LAW--GENERAL REGULATORY PROVISIONS

     

     Introduced By: Representatives Edwards, Filippi, Shanley, Regunberg, and Quattrocchi

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 6-48 of the General Laws entitled "Consumer Empowerment and

Identity Theft Prevention Act of 2006" is hereby amended by adding thereto the following

3

section:

     6-48-8.1. Personal information - prohibition.

5

     No telecommunications or Internet service provider that has entered into a franchise

6

agreement, right-of-way agreement, or other contract with the state of Rhode Island or political

7

subdivision, instrumentality or quasi-public agency of the same, or that uses facilities that are

8

subject to such agreements, even if it is not a party to the agreement, may collect personal

9

information from a customer resulting from the customer's use of the telecommunications or

10

Internet service provider without express written approval from the customer. No such

11

telecommunication or Internet service provider shall refuse to provide its services to a customer

12

on the grounds that the customer has not approved collection of the customer's personal

13

information.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would prevent any state or municipal agency's telecommunications or Internet

2

contractor from collecting and disseminating the personal information of customers.

3

     This act would take effect upon passage.
