It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 45-23-45 of the General Laws in Chapter 45-23 entitled |
2 | "Subdivision of Land" is hereby amended to read as follows: |
3 | 45-23-45. General provisions -- Public design and improvement standards. |
4 | (a) Public design and improvement standards for development projects shall be specified, |
5 | through reasonable, objective standards and criteria, in the design and improvement standards |
6 | section of the local regulations. Appropriate public improvement standards shall be specified for |
7 | each area or district of the municipality. Standards may include, but are not limited to, |
8 | specifications for rights-of-way, streets, sidewalks, lighting, landscaping, public access, utilities, |
9 | drainage systems, fire protection, and soil erosion control. |
10 | (b) All public improvements required in a land development project or subdivision by a |
11 | municipality shall reflect the physical character and design for that district which is specified by |
12 | the municipality's adopted comprehensive plan. Public improvement requirements and standards |
13 | need not be the same in all areas or districts of a municipality. The technical details of the |
14 | improvement standards may be contained in an appendix to the local regulations but shall be |
15 | considered part of the regulations. |
16 | (c) A town or city that requires the installation of a common cistern or any other water |
17 | reservoir for fire protection purposes in a residential subdivision, may by ordinance, provide the |
18 | developer the option in lieu thereof to require the installation of code compliant residential |
19 | sprinkler systems in structures for human habitation. |
