RELATING TO HEALTH AND SAFETY - LONG-TERM CARE COORDINATING

COUNCIL

     

     Introduced By: Representatives Bennett, McNamara, Hull, Costantino, and Slater

It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-17.3-2 of the General Laws in Chapter 23-17.3 entitled "Long-

term Care Coordinating Council" is hereby amended to read as follows:

     23-17.3-2. Membership.

4

     The council shall be comprised of forty-one (41) thirty-nine (39) members, as follows:

5

the lieutenant governor or designee; the secretary of state or designee; the director of the

6

department of health or designee; the director of the department secretary of the office of health

7

and human services or designee; the director of the department of behavioral healthcare,

8

developmental disabilities and hospitals or designee; the attorney general or designee; the director

9

of the department division of elderly affairs or designee; the chair of the Rhode Island advisory

10

commission on aging or designee; the president director of the Rhode Island Chapter of the

11

American Association of Retired Persons (AARP) or designee; the director of the Alliance for

12

Long-term Care state long-term care ombudsman or designee; the president of the Rhode Island

13

Senior Center Directors Association or designee; the executive director of the Rhode Island

14

chapter of the Alzheimer's Association or designee; a representative of a not-for-profit long-term

15

care provider organization other than a nursing home owner, a representative of a long-term care

16

service provider that primarily serves persons with mental retardation or developmental

17

disabilities and a representative of an assisted living residence other than a nursing home, to be

18

appointed by the governor; a representative of a not-for-profit nursing home to be appointed by

the lieutenant governor; five (5) citizens of the state with no direct or indirect interest in nursing

2

home ownership who have demonstrated concern for the care of the elderly, two (2) of whom

3

shall be appointed by the lieutenant governor, two (2) of whom shall be appointed by the speaker

4

of the house of representatives, and one of whom shall be appointed by the President of the

5

senate; a public member with no direct interest in long-term care ownership representing a senior

6

advocacy organization, to be appointed by the governor; a representative of an adult day care

7

center the state program of all-inclusive care of the elderly to be appointed by the speaker; a

8

representative of senior housing to be appointed by the lieutenant governor; a representative of a

9

not-for-profit home health care agency and hospice provider organization to be appointed by the

10

speaker; a representative of a for profit home health care agency to be appointed by the speaker;

11

and a representative of a community mental health center, to be appointed by the president of the

12

senate; a registered nurse experienced in the care of the elderly, to be appointed by the governor;

13

a representative of nonmanagerial nursing home employees, to be appointed by the lieutenant

14

governor; three (3) members of the house, not more than two (2) from the same political party, to

15

be appointed by the speaker; a nursing home owner, to be appointed by the speaker; two (2)

16

members of the senate, not more than one from the same political party to be appointed by the

17

president of the senate; one consumer of home and community based care or a caregiver of a

18

consumer of home and community based care, to be appointed by the speaker from a list of three

19

(3) submitted by the chairperson of the independent living council; one consumer of home and

20

community based care behavioral health services or a representative of a mental health advocacy

21

organization to be appointed by the president of the senate from a list of three (3) submitted by

22

the chairperson of the Governor's Council on Mental Health; a member of the public representing

23

the interests of parents of children with special care needs to be appointed by the president of the

24

senate; a family member of a person with developmental disabilities to be appointed by the

25

speaker of the house; a person with developmental disabilities or a representative of an

26

organization that advocates for the rights of persons with developmental disabilities to be

27

appointed by the lieutenant governor; and a general physician or advanced nurse practitioner with

28

experience in serving persons with long-term care and behavioral needs to be appointed by the

29

president of the senate and a psychiatrist specializing in the medical problems of the elderly, to be

30

appointed by the lieutenant governor. Members of the general public may be appointed in lieu of

31

legislators, provided that at least one member shall be appointed from the house and one from the

32

senate, and the appointments shall be made by the same authority as for the legislators

33

supplanted. The members of the council shall serve two (2) year terms, expiring on the second

34

anniversary of each individual's appointment commencing July 1, 2017, expiring on June 20,

2019, and reappointed every two (2) years thereafter or, on the date that their respective

2

successors are appointed and qualified, whichever is later unless their respective successors are

3

appointed and qualified to fill the remainder of their term.

     SECTION 2. This act shall take effect upon passage.
