It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-17.3-2 of the General Laws in Chapter 23-17.3 entitled "Long- |
2 | term Care Coordinating Council" is hereby amended to read as follows: |
3 | 23-17.3-2. Membership. |
4 | The council shall be comprised of forty-one (41) thirty-three (33) members, as follows: |
5 | the lieutenant governor or designee; the secretary of state or designee; the director of the |
6 | department of health or designee; the director secretary of the department executive office of |
7 | health and human services or designee; the director of the department of behavioral healthcare, |
8 | developmental disabilities and hospitals or designee; the attorney general or designee; the director |
9 | of the department division of elderly affairs or designee; the chair of the Rhode Island advisory |
10 | commission on aging or designee; the president director of the Rhode Island Chapter of the |
11 | American Association of Retired Persons (AARP) or designee; the director of the Alliance for |
12 | Long-term Care state long-term care ombudsman or designee; the president of the Rhode Island |
13 | Senior Center Directors Association or designee; the executive director of the Rhode Island |
14 | chapter of the Alzheimer's Association or designee; a representative of a not-for-profit long-term |
15 | care provider organization other than a nursing home owner, and a representative of a long-term |
16 | care service provider that primarily serves persons with mental retardation or developmental |
17 | disabilities, both to be appointed by the governor; and a representative of an assisted living |
18 | residence other than a nursing home, to be appointed by the lieutenant governor; a representative |

1 | of a not-for-profit nursing home to be appointed by the lieutenant governor; five (5) citizens of |
2 | the state with no direct or indirect interest in nursing home ownership who have demonstrated |
3 | concern for the care of the elderly, two (2) of whom shall be appointed by the lieutenant |
4 | governor, two (2) of whom shall be appointed by the speaker of the house of representatives, and |
5 | one of whom shall be appointed by the President of the senate; a public member with no direct |
6 | interest in long-term care ownership representing a senior advocacy organization, to be appointed |
7 | by the speaker; a representative of an adult day care center the state program of all inclusive care |
8 | of the elderly, to be appointed by the speaker lieutenant governor; a representative of senior |
9 | housing to be appointed by the lieutenant governor; a representative of a not-for-profit home |
10 | health care agency hospice provider organization, to be appointed by the speaker senate president; |
11 | a licensed home care provider or a licensed home nursing care provider, to be appointed by the |
12 | speaker; a representative of a for profit home health care agency to be appointed by the speaker; |
13 | and a representative of a community mental health center, to be appointed by the president of the |
14 | senate; a registered nurse experienced in the care of the elderly, to be appointed by the governor; |
15 | a representative of nonmanagerial nursing home employees, to be appointed by the lieutenant |
16 | governor; three (3) two (2) members of the house, not more than two (2) one from the same |
17 | political party, to be appointed by the speaker; a nursing home owner, to be appointed by the |
18 | speaker; two (2) members of the senate, not more than one from the same political party, to be |
19 | appointed by the president of the senate; one consumer of home and community based care or a |
20 | caregiver of a consumer of home and community based care, to be appointed by the speaker from |
21 | a list of three (3) submitted by the chairperson of the independent living council lieutenant |
22 | governor; one consumer of home and community based care to be appointed by the president of |
23 | the senate from a list of three (3) submitted by the chairperson of the Governor's Council on |
24 | Mental Health behavioral health services or a caregiver of a consumer of behavioral health |
25 | services, to be appointed by the speaker; a member of the public representing the interests of |
26 | parents of children with special care needs, to be appointed by the president of the senate |
27 | governor; a family member of a person with developmental disabilities to be appointed by the |
28 | speaker of the house; a person with developmental disabilities or a representative of an |
29 | organization that advocates for the rights of persons with developmental disabilities, to be |
30 | appointed by the lieutenant governor; a general physician or advanced practice nurse with |
31 | experience in serving persons with long-term care and behavioral health needs, to be appointed |
32 | by the president of the senate; and a psychiatrist specializing in the medical problems of the |
33 | elderly, to be appointed by the lieutenant governor. Members of the general public may be |
34 | appointed in lieu of legislators, provided that at least one member shall be appointed from the |

1 | house and one from the senate, and the appointments shall be made by the same authority as for |
2 | the legislators supplanted and a representative of a managed care health insurer providing long- |
3 | term support and services, to be appointed by the governor. The members of the council shall |
4 | serve two (2) year terms, expiring on the second anniversary of each individual's appointment or |
5 | on the date that their respective successors are appointed and qualified, whichever is later. |
6 | SECTION 2. This act shall take effect upon passage. |
