RELATING TO EDUCATION -- THE EDUCATION EQUITY AND PROPERTY TAX

RELIEF ACT

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-7.2 of the General Laws entitled "The Education Equity and

Property Tax Relief Act" is hereby amended by adding thereto the following section:

     16-7.2-5.1. Cumberland -- Limitations on enrollments.

     The Cumberland town council (the "council") may adopt maximum limits on the number

5

of students from the Cumberland school district permitted to enroll in a charter public school as

6

defined by §16-77-2.1, by individual school or collectively, provided that the collective limit shall

7

not be less than five percent (5%) of the average daily membership of the district as determined

8

pursuant to §16-7-22. If enrollment exceeds the limits adopted by the council pursuant to this

9

section, the council may prohibit the enrollment of additional resident district students in the

10

charter public school, until the number of resident district students enrolled in that charter public

11

school declines below the adopted limit.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELIEF ACT

     This act would permit the Cumberland Town Council to establish limits on the number of

2

students from the Cumberland school district who may enroll in any charter public school subject

3

to a collective limit of not less than five percent (5%) of the average daily membership of the

4

district.

5

     This act would take effect upon passage.
