It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 31-21 of the General Laws entitled "Stopping, Standing, and |
2 | Parking Restrictions" is hereby amended by adding thereto the following section: |
3 | 31-21-18. Electric vehicle charging station parking restrictions. |
4 | (a) For the purposes of this section, "electric vehicle charging station" means a public or |
5 | private parking space that is served by charging equipment that has as its primary purpose the |
6 | transfer of electric energy to a battery or other energy storage device in an electric vehicle. |
7 | (b) No person shall stop, stand, or park a vehicle in any electric vehicle charging station |
8 | provided on any public or private parking space if the vehicle is not connected to the charging |
9 | equipment and where the electric vehicle charging station is indicated by signage identifying the |
10 | station as an electric vehicle charging station and indicating that it is only for electric vehicle |
11 | charging and subject to a parking violation. |
12 | (c) Enforcement of the parking provisions of this section shall be enforced by the local or |
13 | state authorities on public or private property when the location of the parking spaces is within |
14 | the purview of the state building code, chapter 27.3 of title 23. |
15 | (d) Violations of this section are subject to fines enumerated in §31-41.1-4. |
16 | SECTION 2. Section 31-41.1-4 of the General Laws in Chapter 31-41.1 entitled |
17 | "Adjudication of Traffic Offenses" is hereby amended to read as follows: |

1 | (a) The penalties for violations of the enumerated sections, listed in numerical order, |
2 | correspond to the fines described. However, those offenses for which punishments may vary |
3 | according to the severity of the offense, or punishment that require the violator to perform a |
4 | service, shall be heard and decided by the traffic tribunal or municipal court. The following |
5 | violations may be handled administratively through the method prescribed in this chapter. This |
6 | list is not exclusive and jurisdiction may be conferred on the traffic tribunal with regard to other |
7 | violations. |

2 | (b) In addition to any other penalties provided by law, a judge may impose the following |
3 | penalties for speeding: (1) For speeds up to and including ten miles per hour (10 mph) over the |
4 | posted speed limit on public highways, a fine as provided for in subsection (a) of this section for |
5 | the first offense; ten dollars ($10.00) per mile for each mile in excess of the speed limit for the |
6 | second offense if within twelve (12) months of the first offense; and fifteen dollars ($15.00) per |
7 | mile for each mile in excess of the speed limit for the third and any subsequent offense if within |
8 | twelve (12) months of the first offense. In addition, the license may be suspended up to thirty (30) |
9 | days. (2) For speeds in excess of ten miles per hour (10 mph) over the posted speed limit on |
10 | public highways, a mandatory fine of ten dollars ($10.00) for each mile over the speed limit for |
11 | the first offense; fifteen dollars ($15.00) per mile for each mile in excess of the speed limit for the |
12 | second offense if within twelve (12) months of the first offense; and twenty dollars ($20.00) per |
13 | mile for each mile in excess of the speed limit for the third and subsequent offense if within |
14 | twelve (12) months of the first offense. In addition, the license may be suspended up to sixty (60) |
15 | days. (c) Except for a technology surcharge assessed in accordance with § 8-15-11, any person |
16 | charged with a violation who pays the fine administratively pursuant to chapter 41.1 of title 31 |
17 | shall not be subject to any additional costs or assessments, including, but not limited to, the |
18 | hearing fee established in § 8-18-4. |
19 | SECTION 3. This act shall take effect upon passage. |
