RELATING TO TOWNS AND CITIES - EMERGENCY POLICE POWER | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 45-42-3 of the General Laws in Chapter 45-42 entitled "Emergency |
2 | Police Power" is hereby amended to read as follows: |
3 | 45-42-3. Mutual aid -- Campus police officer Mutual aid -- Campus police officer |
4 | and special police officer. |
5 | (a) Any public or private educational institution of higher learning located in this state, |
6 | with a police or other public safety department consisting of campus police officers appointed |
7 | pursuant to chapter 52 of title 16, or special police officers appointed pursuant to chapter 2.1 of |
8 | title 12, may enter a mutual aid agreement with the city or town in which the institution is |
9 | primarily located, solely for the purpose of providing emergency assistance in response to |
10 | specific incidents at the request of the police chief of the city or town. Officers appointed under |
11 | this these chapter chapter's must have satisfactorily completed a training academy certified by the |
12 | Police Officer's Commission on Standards and Training. |
13 | (b) The mutual aid agreement will not be effective until formally approved by the city or |
14 | town council in which the institution is located, after a public hearing and by the governing body |
15 | or office of the institution of higher learning. |
16 | (c) The special police officers responding to a request for emergency assistance pursuant |
17 | to a duly approved mutual aid agreement shall have the same authority, powers, duties, privileges, |
18 | and immunities for jurisdictional purposes as a duly appointed police officer of the city or town |
19 | making the request. |

1 | (d) The special police officers responding to the request for emergency assistance under |
2 | the mutual aid agreement shall be subject to, and considered within, the control and authority of |
3 | the requesting chief of police for the duration of the emergency and until released by the |
4 | requesting chief of police. |
5 | SECTION 2. This act shall take effect upon passage. |

1 | This act would amend the statutory provisions regarding emergency police powers to |
2 | clarify that higher learning institutions having special police officers are authorized to enter into |
3 | mutual aid agreements with the municipality where the institution is located for the purpose of |
4 | providing emergency assistance. Special police officers appointed under this chapter must |
5 | complete a training academy certified by the Police Officer's Commission on Standards and |
6 | Training. |
7 | This act would take effect upon passage. |
