A N   A C T

RELATING TO MOTOR AND OTHER VEHICLES -- DIVISION OF MOTOR VEHICLES

     

     Introduced By: Senators Felag, DiPalma, McCaffrey, Lynch Prata, and Seveney

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-2 of the General Laws entitled "Division of Motor Vehicles" is

2

hereby amended by adding thereto the following sections:

3

     31-2-3.1. Division of motor vehicles service member licensure.

4

     (a) The administrator of the division of motor vehicles and each of their examining and

5

licensing boards shall, upon presentation of satisfactory evidence by an applicant for certification

6

or licensure, accept education, training, or service completed by an individual as a member of the

7

Armed Forces or Reserves of the United States, the National Guard of any state, the Military

8

Reserves of any state, or the Naval Militia of any state toward the qualifications to receive the

9

license or certification. The administrator of the division of motor vehicles and each of their

10

examining and licensing boards shall promulgate rules to implement this section.

11

     (b) The administrator and each of their examining and licensing boards shall establish a

12

procedure to expedite the issuance of a license, certification or permit to perform professional

13

services regulated by each such board to a person who is certified or licensed in another state to

14

perform professional services in a state other than Rhode Island. The procedure shall include:

15

     (1) Issuing the person a license, certificate or permit, if, in the opinion of the

16

administrator or their board members, the requirements for certification or licensure of such other

17

state are substantially equivalent to that required in this state; or

18

     (2) Developing a method to authorize the person to perform professional services

19

regulated by the administrator and their board members in this state by issuing the person a

temporary permit for a limited period of time to allow the person to perform professional services

2

while completing any specific requirements that may be required in this state that were not

3

required in the state in which the person was licensed or certified.

     31-2-3.2. Division of motor vehicles military spouse licensure.

     (a) The division of motor vehicles shall establish a procedure to expedite the issuance of

6

a license, certification or permit to perform professional services regulated by the division to a

7

person:

8

     (1) Who is certified or licensed in another state to perform professional services in a state

9

other than Rhode Island;

10

     (2) Whose spouse is a member of the armed forces of the United States;

11

     (3) Whose spouse is the subject of a military transfer to Rhode Island; and

12

     (4) Who left employment to accompany the person's spouse to Rhode Island.

13

     (b) The procedure shall include:

14

     (1) Issuing the person a license, certificate or permit, if, in the opinion of the

15

administration, the requirements for certification or licensure of such other state are substantially

16

equivalent to that required in this state; or

17

     (2) Developing a method to authorize the person to perform professional services

18

regulated by the division in this state by issuing the person a temporary permit for a limited

19

period of time to allow the person to perform professional services while completing any specific

20

requirements that may be required in this state that were not required in the state in which the

21

person was licensed or certified.

     SECTION 2. Chapter 42-11 of the General Laws entitled "Department of

23

Administration" is hereby amended by adding thereto the following sections:

24

     42-11-2.7. Department of administration service member licensure.

25

     (a) The director of the department of administration and each of their examining and

26

licensing boards shall, upon presentation of satisfactory evidence by an applicant for certification

27

or licensure, accept education, training, or service completed by an individual as a member of the

28

Armed Forces or Reserves of the United States, the National Guard of any state, the Military

29

Reserves of any state, or the Naval Militia of any state toward the qualifications to receive the

30

license or certification. The director of the department of administration and each of their

31

examining and licensing boards shall promulgate rules to implement this section.

other than Rhode Island;

EXPLANATION

certifications and licenses issued by the division of motor vehicles and the department of
