RELATING TO ALCOHOLIC BEVERAGES -- REGULATION OF SALES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 3-8-10 of the General Laws in Chapter 3-8 entitled "Regulation of |
2 | Sales" is hereby amended to read as follows: |
3 | 3-8-10. Possession of beverage by underage persons. |
4 | Any person who has not reached his or her twenty-first (21st) birthday and has in his or |
5 | her possession any beverage as defined in this title shall be fined one hundred fifty dollars ($150) |
6 | to seven hundred fifty dollars ($750) for the first offense, three hundred dollars ($300) to seven |
7 | hundred fifty dollars ($750) for the second offense, and four hundred fifty dollars ($450) to nine |
8 | hundred fifty dollars ($950) for the third or subsequent offense. In addition, any person who |
9 | violates this section shall be required to perform thirty (30) hours of community service and shall |
10 | be subject to a minimum sixty (60) day suspension of his or her driver's license, and upon a |
11 | second offense may be ordered to undergo a substance abuse assessment by a licensed substance |
12 | abuse professional. Notwithstanding the provisions of ยง11-1-2, any offense committed under this |
13 | section shall be a violation. |
14 | SECTION 2. This act shall take effect upon passage. |

1 | This act would provide that a person under the age of twenty-one (21) years of age who is |
2 | convicted of possession of an alcoholic beverage has committed a violation, and not a felony or |
3 | misdemeanor. |
4 | This act would take effect upon passage. |
