RELATING TO PUBLIC PROPERTY AND WORKS -- STATE CONTRACTS ANTI-

DISCRIMINATION

     

     Introduced By: Senators Goldin, Calkin, Satchell, Miller, and Coyne

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 37-2.6-3 of the General Laws in Chapter 37-2.6 entitled "Anti-

Discrimination in State Contracts" is hereby amended to read as follows:

     37-2.6-3. Discrimination in state contracts prohibited.

     (a) A public entity shall not enter into a contract with a business to acquire or dispose of

5

supplies, services, information technology, or construction unless the contract includes a

6

representation that the business is not currently engaged in, and an agreement that the business

7

will not during the duration of the contract engage in, the boycott of any person, firm, or entity

8

based in, or doing business with, a jurisdiction with whom the state can enjoy open trade, and/or

9

the boycott of any public agencies, entities, or instrumentalities of the jurisdiction with whom the

10

state can enjoy open trade.

     (b) No department, division, board, commission, commissioner, committee, agent,

12

officer, person, or institution for whom an appropriation is made, or who receives money or who

13

is authorized to expend or to collect money for the state may discriminate against anyone on the

14

basis of race, color, religion, sex as defined in §28-5-6, disability as defined in §42-87-1, age as

15

defined in §28-5-6, country of ancestral origin, sexual orientation as defined in §28-5-6, or gender

16

identity or expression as defined in §28-5-6.

     SECTION 2. This act shall take effect upon passage.

     This act would prohibit any state agency, department or person which is authorized to

2

expend or collect money for the state, from discrimination based upon race, color, religion, sex,

3

disability, age, country of ancestral origin, sexual orientation or gender identity or expression.

4

     This act would take effect upon passage.
