	RELATING TO AGRICULTURE AND FORESTRY -- AGRICULTURAL FUNCTIONS

	It is enacted by the General Assembly as follows:
1	SECTION 1. Section 2-1-10 of the General Laws in Chapter 2-1 entitled "Agricultural
2	Functions of Department of Environmental Management" is hereby amended to read as follows:
3	2-1-10. Inspection powers.
4	(a) For the purpose of conducting inspections, the director of environmental management
5	and the director of health, or any of his or her agents or deputies, have authority to enter, at any
6	reasonable time, any building, storehouse, warehouse, cold-storage plant, packing house,
7	stockyard, railroad yard, railroad car, or any other building or place where farm products are
8	produced, kept, stored, or offered for sale, or to enter upon any farm land for the purpose of
9	inspecting farm products.
10	(b) The director of the department of environmental management, in consultation with
11	the director of the department of health, shall enforce the commercial growers of fruits and
12	vegetables voluntary food safety program developed by the Food and Drug Administration and
13	the United States Department of Agriculture known as Good Agricultural Practices (GAP), and
14	shall enforce the Food Safety Modernization Act as it pertains to commercial growers of fruits
15	and vegetables.
16	SECTION 2. This act shall take effect upon passage.

1	This act would require the director of department of environmental management to
2	enforce the Federal Good Agriculture Practices Act and the Food Safety Modernization Act as it
3	pertains to commercial growers of fruits and vegetables.
4	This act would take effect upon passage.
