RELATING TO HEALTH AND SAFETY - LONG-TERM CARE COORDINATING | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-17.3-2 of the General Laws in Chapter 23-17.3 entitled "Long-term |
2 | Care Coordinating Council" is hereby amended to read as follows: |
3 | 23-17.3-2. Membership. |
4 | The council shall be comprised of forty-one (41) members thirty-one (31), as follows: the |
5 | lieutenant governor or designee; the secretary of state or designee; the director of the department |
6 | of health or designee; the director secretary of the department office of health and human services |
7 | or designee; the director of the department of behavioral healthcare, developmental disabilities |
8 | and hospitals or designee; the attorney general or designee; the director of the department division |
9 | of elderly affairs or designee; the chair of the Rhode Island advisory commission on aging or |
10 | designee; the president director of the Rhode Island Chapter of the American Association of |
11 | Retired Persons (AARP) or designee; the director of the Alliance for Long-term Care state long- |
12 | term care ombudsman or designee; the president of the Rhode Island Senior Center Directors |
13 | Association or designee; the executive director of the Rhode Island chapter of the Alzheimer's |
14 | Association or designee; a representative of a not-for-profit long-term care provider organization |
15 | other than a nursing home owner, a representative of a long-term care service provider that |
16 | primarily serves persons with mental retardation or developmental disabilities and a |
17 | representative of an assisted living residence other than a nursing home, to be appointed by the |
18 | governor; a representative of a not-for-profit nursing home to be appointed by the lieutenant |

1 | governor; five (5) citizens of the state with no direct or indirect interest in nursing home |
2 | ownership who have demonstrated concern for the care of the elderly, two (2) of whom shall be |
3 | appointed by the lieutenant governor, two (2) of whom shall be appointed by the speaker of the |
4 | house of representatives, and one of whom shall be appointed by the President of the senate a |
5 | public member with no direct interest in long-term care ownership representing a senior advocacy |
6 | organization, to be appointed by the governor; a representative of an adult day care center the |
7 | state program of all inclusive care of the elderly, to be appointed by the speaker lieutenant |
8 | governor; a representative of senior housing to be appointed by the lieutenant governor; a |
9 | representative of a not-for-profit home health care agency and hospice provider organization, to |
10 | be appointed by the speaker senate president; a representative of a for profit home health care |
11 | agency to be appointed by the speaker; and a representative of a community mental health center, |
12 | to be appointed by the president of the senate; a registered nurse experienced in the care of the |
13 | elderly, to be appointed by the governor; a representative of nonmanagerial nursing home |
14 | employees, to be appointed by the lieutenant governor; three (3) two (2) members of the house, |
15 | not more than two (2) one from the same political party, to be appointed by the speaker; a nursing |
16 | home owner, to be appointed by the speaker; two (2) members of the senate, not more than one |
17 | from the same political party, to be appointed by the president of the senate; one consumer of |
18 | home and community based care or behavioral health services or representative of a mental health |
19 | advocacy organization, to be appointed by the speaker from a list of three (3) submitted by the |
20 | chairperson of the independent living council senate president; one consumer of home and |
21 | community based care behavioral health services or representative of a mental health advocacy |
22 | organization, to be appointed by the president of the senate from a list of three (3) submitted by |
23 | the chairperson of the Governor's Council on Mental Health speaker; a member of the public |
24 | representing the interests of parents of children with special care needs, to be appointed by the |
25 | president of the senate governor; a family member of a person with developmental disabilities to |
26 | be appointed by the speaker of the house; a person with developmental disabilities or a |
27 | representative of an organization that advocates for the rights of persons with developmental |
28 | disabilities, to be appointed by the lieutenant governor; and a general physician or advanced |
29 | practice nurse with experience in serving persons with long-term care and behavioral health |
30 | needs, to be appointed by the president of the senate and a psychiatrist specializing in the |
31 | medical problems of the elderly, to be appointed by the lieutenant governor. Members of the |
32 | general public may be appointed in lieu of legislators, provided that at least one member shall be |
33 | appointed from the house and one from the senate, and the appointments shall be made by the |
34 | same authority as for the legislators supplanted. The members of the council shall serve two (2) |

1 | year terms, expiring on the second anniversary of each individual's appointment or on the date |
2 | that their respective successors are appointed and qualified, whichever is later. |
3 | SECTION 2. This act shall take effect upon passage. |
