RELATING TO TOWNS AND CITIES - MUNICIPAL CONTRACTS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 45-55-2 of the General Laws in Chapter 45-55 entitled "Award of |
2 | Municipal Contracts" is hereby amended to read as follows: |
3 | 45-55-2. Method of source selection. |
4 | Except as otherwise authorized by law, all municipal contracts shall be awarded by: |
5 | (1) Competitive sealed bidding, pursuant to § 45-55-5; |
6 | (2) Competitive negotiations, pursuant to § 45-55-6; |
7 | (3) Non-competitive negotiations, pursuant to §§ 45-55-7 and 45-55-8; |
8 | (4) Small purchase procedures, pursuant to § 45-55-9. |
9 | (5) Qualification based selection (QBS) process for architects/engineers pursuant to § 45- |
10 | 55-8.1 and program managers, construction managers, or construction managers at risk pursuant |
11 | to §45-55-8.2. |
12 | SECTION 2. Chapter 45-55 of the General Laws entitled "Award of Municipal |
13 | Contracts" is hereby amended by adding thereto the following section: |
14 | 45-55-8.2. Qualification based selection of program managers, construction |
15 | managers, or construction managers at risk. |
16 | When the purchasing agent determines that the city or town needs the services of a |
17 | program manager, construction manager, or construction manager at risk, the purchasing agent |
18 | shall follow the regulations, as defined in §45-55-4, for qualification based selection for the |
19 | procurement of such services. |
