A N   A C T

RELATING TO INSURANCE - CASUALTY INSURANCE GENERALLY

     Introduced By: Senators Conley, Gallo, Lynch Prata, and McCaffrey

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 27-8 of the General Laws entitled "Casualty Insurance Generally"

is hereby amended by adding thereto the following section:

     27-8-1.1. Vacant property.

     (a) No residential property shall be declared vacant under any policy of insurance after a

period of thirty (30) or less days; provided, that the owner of the residential property is in the

process of renovation and/or rehabilitation of the premises pursuant to the issuance of the

appropriate building permits by the municipality wherein the property is located.

     (b) The process of renovation and/or rehabilitation shall commence upon the date when

the application for the issuance of a building permit is filed and shall cease upon the date when

the renovation and/or rehabilitation is completed and a certificate of occupancy has been

obtained.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

     This act would exempt residential property from the definition of vacant property

provided the owner of the property is in the process of renovation and/or rehabilitation pursuant

to building permits issued by the local municipality from the date of application for the permits to

the date of completion of the renovation and/or rehabilitation and the issuance of a certificate of

occupancy.

     This act would take effect upon passage.
