It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 21-31 of the General Laws entitled "Rhode Island Food, Drugs, |
2 | and Cosmetics Act" is hereby amended by adding thereto the following section: |
3 | 21-31-25. Findings and declarations. |
4 | (a) Findings and declarations. The general assembly hereby finds and declares that Rhode |
5 | Island consumers have the right to know all the ingredients contained in the menstrual products |
6 | they purchase so they can make informed health-related purchasing decisions. Labeling is |
7 | necessary to ensure that Rhode Island consumers are fully and reliably informed about the |
8 | products they purchase and consume. Labels provide informed consent and prevent consumer |
9 | deception. In the United States, there is currently no federal or Rhode Island requirement that all |
10 | the ingredients contained in menstrual products be labeled. |
11 | (b) Labeling of menstrual products. Any menstrual product sold by a retail business in |
12 | this state, such as menstrual cups; scented, scented deodorized, or unscented menstrual pads or |
13 | tampons; therapeutic vaginal douche apparatuses; or obstetrical and gynecological devices |
14 | described in section 884.5400, 884.5425, 884.5435, 884.5460, 884.5470, or 884.5900 of title 21, |
15 | Code of Federal Regulations (or any successor regulation), shall be deemed to be misbranded |
16 | under the provisions of this chapter unless it bears a label listing the name of each ingredient or |
17 | component of the device in order of the most predominant ingredient or component to the least |
18 | predominant ingredient or component. |
