RELATING TO CRIMINAL OFFENSES -- BURGLARY AND BREAKING AND ENTERING | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 11-8-6 of the General Laws in Chapter 11-8 entitled "Burglary and |
2 | Breaking and Entering" is hereby repealed. |
3 | 11-8-6. Entry to steal poultry -- Arrest -- Fine. |
4 | Every person who breaks and enters, or enters in the nighttime without breaking, any |
5 | building or enclosure in which are kept or confined any kind of poultry, with intent to steal any of |
6 | the poultry, shall be punished by imprisonment for not more than five (5) years, or by a fine of |
7 | not more than five hundred dollars ($500), or both. Every person who is discovered in the act of |
8 | willfully entering any building or enclosure in which are kept or confined any kind of poultry, |
9 | with intent to steal any of the poultry, may be arrested without a warrant by a deputy sheriff, town |
10 | constable, guard, police officer, or other person and detained in jail or otherwise until a complaint |
11 | can be made against him or her for the offense, and until he or she is taken on a warrant issued |
12 | upon the complaint, but detention without a warrant shall not continue more than twenty-four |
13 | (24) hours. One-half (1/2) of any fine imposed under this section shall inure to the complainant. |
14 | SECTION 2. This act shall take effect upon passage. |
