RELATING TO FOOD AND DRUGS - SODA AND CREAM OF TARTAR | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Sections 21-26-1, 21-26-2, 21-26-3 and 21-26-4 of the General Laws in |
2 | Chapter 21-26 entitled "Soda and Cream of Tartar" are hereby repealed. |
3 | 21-26-1. Appointment of municipal inspectors. |
4 | The city and town councils of the several cities and towns may, appoint an inspector of |
5 | saleratus, bicarbonate of soda, and cream of tartar for the cities and towns. |
6 | 21-26-2. Testing and certification -- Fee. |
7 | Every inspector shall, whenever requested, test any of the articles which shall be |
8 | presented to him or her for inspection, and shall give his or her certificate to any person applying |
9 | for it, whether the article is impure or adulterated, and for every certificate the inspector shall be |
10 | entitled to the sum of two dollars ($2.00). |
11 | 21-26-3. Analysis -- Fee. |
12 | Every inspector shall, whenever requested, make an analysis of an article which may be |
13 | presented to him or her for that purpose, and shall give his or her certificate to any person who |
14 | shall apply for it, of the result of the analysis, for which certificate he or she shall be entitled to |
15 | the sum of ten dollars ($10.00). |
16 | 21-26-4. Sale of adulterated articles. |
17 | Every person who shall sell saleratus, bicarbonate of soda, or cream of tartar which has |
18 | been adulterated and thereby rendered an impure article, shall be fined twenty dollars ($20.00), |
19 | together with the cost of testing and analyzing the impure article; one-half (1/2) of the fine to the |

1 | use of the city or town where the sale shall be made, and one-half (1/2) of the fine, together with |
2 | the cost of testing and analyzing the impure article, to the use of the person who shall sue for it. |
3 | SECTION 2. This act shall take effect upon passage. |
