RELATING TO BEHAVIORAL HEALTHCARE, DEVELOPMENTAL DISABILITIES AND

HOSPITALS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 40.1-21-10 of the General Laws in Chapter 40.1-21 entitled

"Division of Developmental Disabilities" is hereby amended to read as follows:

     40.1-21-10. Appropriations.

     (a) The general assembly shall annually appropriate such sums as it deems necessary to

enable the director of behavioral healthcare, developmental disabilities and hospitals to provide or

secure services for developmentally disabled adults of this state; and the state controller is hereby

authorized and directed to draw his or her orders upon the general treasurer for the payment of

such sum or sums or so much thereof as may be required from time to time, upon the receipt by

him or her of vouchers properly authenticated.

     (b) In the event that the general assembly approves an increase to the state's minimum

wage rate, the funding appropriated to staffing for development disabilities direct support services

shall be increased by an equal amount and shall be effective on the date the minimum wage rate

change takes effect.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would increase funding appropriated to staffing for developmental disabilities

direct support services by an equal amount when an increase of the minimum wage rate occurs.

     This act would take effect upon passage.
