RELATING TO PUBLIC UTILITIES AND CARRIERS -- MOTOR CARRIERS OF

PROPERTY

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 39-12 of the General Laws entitled "Motor Carriers of Property" is

hereby amended by adding thereto the following section:

     39-12-12.1. Certificated towers tariff adjustment.

     Notwithstanding any other provision of this chapter to the contrary, tow operators

certificated pursuant to § 39-12-6 may as of January 1, 2020, and every year thereafter, increase

and adjust tariff rates and charges. Adjustments may increase the established usual and customary

accepted and published rates and charges. The maximum adjusted increase shall be the total

percentage increase in the Consumer Price Index for all Urban Consumers (CPI-U) published by

the United States Department of Labor Bureau of Labor Statistics for the Northeast Region for

the previous fiscal year, but in no event shall the increase exceed eight percent (8%). The

adjustment of rates and charges shall be published pursuant to § 39-12-11.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

PROPERTY

     This act would allow tow truck operators as of January 1, 2020, to annually raise rates

and charges consistent with the increase in the Consumer Price Index to a maximum of eight

percent (8%).

     This act would take effect upon passage.
