It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 31-4-11 of the General Laws in Chapter 31-4 entitled "Transfer of |
2 | Vehicles" is hereby amended to read as follows: |
3 | 31-4-11. Sale of automobiles -- Required equipment. |
4 | (a) No automobile shall be sold, whether new or used, by a dealer, at wholesale or retail, |
5 | unless the automobile is equipped with a spare tire and a jack, both of which must be functional |
6 | and operational. The provisions of this section shall not apply: |
7 | (1) To an automobile equipped with tires that without any tire air inflation permit vehicle |
8 | operation for at least fifty (50) miles at speeds up to at least fifty-five (55) miles per hour; or |
9 | (2) An automobile equipped with a factory installed tire repair and inflation system; or |
10 | (3) To an automobile equipped with self-sealing tires or other technological |
11 | improvements, consistent with federal motor vehicle safety standards. |
12 | (b) A violation of this section subsection (a) of this section shall constitute a |
13 | misdemeanor. |
14 | (c) For each sale of a new or used vehicle by a dealer, the dealer shall provide a written |
15 | disclosure that the vehicle actually has a spare tire and jack or the vehicle is equipped with one of |
16 | the exceptions to a spare tire and jack as provided in this section. There shall be a civil penalty of |
17 | one hundred dollars ($100) for a violation under this subsection. |

1 | This act would require motor vehicle dealers to disclose in writing that a vehicle being |
2 | sold has a spare tire and jack or is otherwise equipped in compliance with applicable law with an |
3 | exemption for automobiles equipped with self-sealing tires. There shall be a civil penalty of one |
4 | hundred dollars ($100) for a violation under this subsection. |
5 | This act would take effect upon passage. |
